Terms of Service
1. Who we are and these terms
1.1 Makeborne is provided by ZORBY&CO d.o.o., Vilsonovo šetalište 10, 71000 Sarajevo, Bosnia and Herzegovina, ID number (JIB) 4203428970007 ("we", "us"). Contact: admin@makeborne.com. Full company details are in the Legal notice.
1.2 These terms, the Subscription, credit and refund terms (the "Billing terms"), the Privacy Policy and, where you add other people's personal data, the Data Processing Agreement form the agreement between you and us. You accept them when you create an account ("By creating an account you agree to the Terms and acknowledge the Privacy Policy") or use Makeborne. If these terms and the Billing terms conflict on payment, credits or refunds, the Billing terms apply.
2. Who can use Makeborne
2.1 You must be at least 18 and able to enter a binding contract. If you use Makeborne for a business, you confirm you may bind it, and "you" includes that business.
2.2 Makeborne is offered worldwide to businesses and consumers. You may not use it if you are in a country, or are a person, subject to UN, EU, UK or US sanctions or embargoes, or if export-control law prohibits it.
3. Your account
Keep your sign-in details secure and tell us at once about any unauthorised use. You are responsible for activity in your account and for the members you add to your workspaces. Give us accurate information and keep your email address up to date.
4. The service
4.1 Makeborne lets you create websites, books and presentations with AI help, edit them, publish websites on Makeborne hosting, share work for client review and keep client records. Some features are available only on some plans, are marked "coming soon", or depend on third parties.
4.2 We improve Makeborne continuously and may change, add or remove features. We will not make a change that materially reduces a paid feature during a period you have already paid for without telling you in advance; if it harms you, you may cancel and receive a pro-rata refund of the unused part of that period.
4.3 We aim for high availability but do not promise uninterrupted service. Maintenance, provider outages and security measures can interrupt it.
5. Plans, credits and payment
5.1 Paid plans, credits, renewal, cancellation and refunds are described in the Billing terms. In short: plans renew automatically until you cancel in your Whop account; credits are usage allowances, not money; unused plan credits stay usable for two months after their month ends; and a payment is refundable in full while none of its credits have been used.
5.2 Checkout is handled by Whop, Inc. as our payment processor. We are the seller and the supplier of Makeborne and handle applicable sales tax and VAT ourselves. Our advertised consumer prices include applicable tax. Whop does not calculate, collect or display tax for us. Whop shows any additional checkout fee before you pay; your bank may separately charge currency-conversion or foreign-transaction fees.
6. Consumers: your right to withdraw
6.1 If you are a consumer in the EU, the EEA or the UK, you may withdraw from a purchase within 14 days of the day the contract was made, without giving a reason. To withdraw, use the withdrawal page, email admin@makeborne.com with your Whop payment reference, or send the model form below. Sending it before the 14 days end is enough.
6.2 At checkout you ask us to start immediately. If you then withdraw, we refund the payment, less an amount in proportion to what you used: the credits you used from that payment, as a share of all credits included in its paid term. If you used none, you get a full refund. We refund within 14 days of receiving your withdrawal, through Whop, to your original payment method.
6.3 Our voluntary policy goes further: any payment stays fully refundable while none of its credits are used, even after 14 days. Consumers elsewhere keep every right their local law gives them.
Model withdrawal form (complete and return it only if you wish to withdraw):

7. Acceptable use
7.1 You must not use Makeborne, or anything you make with it, to:
- break the law, or create or publish content that is illegal, defamatory, harassing, hateful, violent-extremist, or that sexualises or endangers children;
- infringe anyone's copyright, trademark, privacy or other rights, or upload material you have no right to use;
- impersonate a person or brand, or build deceptive, phishing, fraudulent or scam sites, fake reviews or misleading claims;
- distribute malware, or attack, probe, overload or circumvent the security or limits of Makeborne or any other system;
- send spam or unlawful outreach: when you contact leads or clients you must follow the email, phone and marketing laws that apply to them (for example the EU ePrivacy rules, UK PECR, US CAN-SPAM and Canada's CASL), honour opt-outs, and identify yourself;
- collect or use personal data without a lawful basis, including data from the lead finder; you must tell the people concerned how you got their data where the law requires it (GDPR Art. 14);
- scrape, copy or resell Makeborne, or use it to build a competing dataset or model;
- create content that gives regulated professional advice (for example legal, medical or financial) without the qualifications and disclosures the law requires.
7.2 Report abuse or illegal content to admin@makeborne.com. Say where it is, why it is unlawful and how to reach you. We review notices promptly, may remove or disable content, and tell the affected customer why, unless the law or safety prevents it. You can reply to a decision and ask us to review it.
8. Your content and what Makeborne makes
8.1 You own your content and the output. Everything you upload or write, and the websites, books, presentations, images and text Makeborne generates for you, belong to you as between you and us. We assign to you any rights we may have in the output. Some AI output may not be protected by copyright, and similar output may be produced for other customers.
8.2 You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, display and publish your content and output only as needed to run Makeborne for you, keep it secure, and meet legal duties. The licence ends when the content is deleted, except for backups awaiting their normal overwrite and copies we must keep by law.
8.3 No AI training. We do not use your content or output to train AI models, and our AI providers' terms prohibit them from training on it.
8.4 We will not show your work as an example or in marketing unless you opt in. You can withdraw that opt-in at any time.
8.5 Makeborne's software, design, templates, styles, components and brand stay ours. You may use any template or component that appears in your output as part of that output. Fonts and other third-party materials come with their own licences, which are listed in your source export.
8.6 Feedback you send may be used by us freely, without obligation to you.
9. AI output
AI output can be wrong, incomplete or similar to other works. Review it before you rely on it, publish it or send it, especially facts, prices, legal statements and claims about people or businesses. It is not professional advice, and we do not guarantee that it is free of third-party rights. Content Makeborne generates is AI-generated; label it as such where the law requires.
10. Published websites and your clients
10.1 You are responsible for the websites you publish and for everything on them, including their own legal notice, privacy policy, cookie notice, terms and any consents your visitors must give. Makeborne hosting adds no tracking cookies; visitor counts are cookieless, and form enquiries are stored for you.
10.2 When you store your leads', clients' or website visitors' personal data in Makeborne, you are its controller and we process it for you under the Data Processing Agreement, which forms part of these terms.
10.3 When your subscription ends, your websites stay saved but stop being served. You can export your work.
11. Third-party services
Whop (payments), GitHub (repository export), Google (sign-in and, if you connect it, Gmail sending), domain registrars and other services you connect have their own terms, which apply between you and them. We are not responsible for them, but we will only access them as you authorise.
12. Suspension and termination
12.1 You can stop using Makeborne and ask us to delete your account at any time by email (or in Settings, where that option is shown). Cancel your subscription in Whop to stop renewal.
12.2 We may suspend or restrict an account, a site or a feature immediately if it breaches these terms or the law, endangers others, or a payment is reversed; otherwise we give notice first. We may end the agreement for any reason with 30 days' notice, and then refund any unused prepaid amount.
12.3 After the agreement ends, published sites go offline and your data is deleted as described in the Privacy Policy. Sections 8, 9 and 13 to 16 survive.
13. Warranties
We provide Makeborne with reasonable skill and care. Consumers keep all statutory guarantees, including that the service matches its description. Otherwise, to the extent the law allows, Makeborne is provided "as is" without other warranties.
14. Liability
14.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for intentional misconduct or gross negligence, or any other liability that cannot lawfully be limited. Consumers keep their mandatory statutory rights.
14.2 Subject to 14.1, neither party is liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill, and our total liability arising out of the agreement in any 12 months is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
14.3 Keep your own copies of important work; you can export it at any time.
15. Indemnity (businesses only)
If you use Makeborne as a business, you will compensate us for reasonable losses and costs from third-party claims arising from your content, your websites, your outreach or your breach of these terms.
16. Changes, law and disputes
16.1 We may change these terms for legal, security or product reasons. We will give at least 30 days' notice by email or in the app of changes that affect you adversely. If you don't agree, you may cancel before they apply and get a pro-rata refund of the unused prepaid period. Continued use after that date means you accept them.
16.2 These terms are governed by the law of Bosnia and Herzegovina, and the competent courts in Sarajevo have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings in your local courts; this choice does not deprive you of those rights.
16.3 Tell us about a complaint at admin@makeborne.com and we will try to resolve it within 14 days. The EU online dispute resolution platform closed on 20 July 2025. We are not obliged to take part in alternative dispute resolution, but will consider a proposal in good faith.
17. General
We send notices to your account email; you send them to admin@makeborne.com. You may not transfer this agreement without our consent; we may transfer it to a successor of our business with notice. If a clause is invalid, the rest stays in force. These terms are the entire agreement on their subject. They are written in English, which is the binding version.
